Dunia Link Communications Limited (referred to as "Dunia Link") provide this web site and services to you under the following terms and conditions of use. These terms and conditions apply to your use of all of the sites and services owned or operated by Dunia Link, including www.dunialink.com, and any other site that Dunia Link may own or operate in the future (collectively, the "Dunia Link Sites")

Description of Service

Dunia Link provides users with access to a collection of resources. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Dunia Link services, shall be subject to these Terms and Conditions of Use. You understand and agree that the Service is provided "AS-IS" and that Dunia Link assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store or reproduce any user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or air time charges). You are responsible for those fees including any fees that may be charged by Dunia Link for access to branded content. In addition, you must provide and are responsible for all equipment necessary to access the Service.

Registration

Certain Dunia Link services may require the eligible user to open an account. If you are eligible for these services and wish to open an account, you must complete the registration process by providing Dunia Link with current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and an user name. You are entirely responsible for maintaining the confidentiality of your password and account.

In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the applicable registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Dunia Link has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Dunia Link has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

User Account

You are entirely responsible for any and all activities that occur under your account. You agree to notify Dunia Link immediately of any unauthorized use of your account or any other breach of security. Dunia Link will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Dunia Link or another party due to you or someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

Restrictions on Use of Materials

The contents of the Dunia Link Sites are protected by copyright and trademark laws, and are the property of Dunia Link and any and all other owners. Unless Dunia Link give you express written permission, you may access the materials located on the Dunia Link Sites only for your personal use. This means you may download one copy of such materials on a single computer for personal, noncommercial use only, so long as you neither change nor delete any author attribution, trademark, legend or copyright notice. When you download copyrighted material you do not obtain any ownership or other rights in that material.

Except as stated above, without Dunia Link's prior written consent you may not otherwise modify, copy, publish, display, transmit, adapt or in any way exploit the content of Dunia Link Sites. You may also be required to obtain permission from third parties owning or holding an interest in certain content, products or services. Even if permission is granted by Dunia Link and by all other entities owning or holding such an interest, you may not change or delete any author attribution, trademark, legend or copyright notice.

You must abide by all additional copyright notices or other restrictions contained in any of Dunia Link Sites.

Dunia Link is not responsible for the availability of any third party site to which any of the Dunia Link Sites links. Dunia Link does not endorse or take responsibility for the contents, information, advertising, products or other materials made available through any third party site. With respect to any content, goods or services available on any third party site, under no circumstances will Dunia Link be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of, or reliance on, any such content, information or materials. You should direct any concerns to that third party site's administrator or webmaster.

Other sites may link to Dunia Link Sites only as approved by Dunia Link. Contact Dunia Link at contact@dunialink.com. Dunia Link reserves the right to rescind any permission and to require termination of any such link to any of Dunia Link Sites, at Dunia Link's discretion at any time.

Interactive Features

An "interactive feature" means any type of forum, message board, chat room, annotation feature, or similar interactive service appearing on any of the Dunia Link Sites, now or in the future. You must register in accordance with instructions that you will find on Dunia Link Sites in order to contribute to any interactive feature. No person under age 18 may register with Dunia Link, or contribute to any interactive feature.

You may not contribute to any interactive feature any material that is libelous defamatory, obscene, abusive, invades a person's privacy, violates any intellectual property rights, or that would otherwise violate any law. You may not use any interactive feature in a commercial manner. You may not post material that solicits funds, or that advertises or solicits goods or services. You may not post material known to be false. You may not post or transmit any information, software or other material that contains a virus or other harmful component.

Dunia Link is not responsible for material appearing in any interactive feature on the Dunia Link Sites, except for material signed by an identified representative of Dunia Link. Dunia Link is not responsible for screening material posted by users for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or for any other reason. Dunia Link retains, however, the right to modify or remove messages or material that Dunia Link, in its sole discretion, considers infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. Whether or not Dunia Link modifies or removes such material, users remain solely responsible for the content of their messages or postings.

You agree that by submitting information for inclusion in any interactive feature, you consent to the publication of that information in these interactive features. You also give (or warrant that the owner of such rights has expressly granted) Dunia Link and/or any affiliated entities the perpetual, nonexclusive right to use such materials (including your questions, comments, and other postings), in their original or edited form, on Dunia Link Sites, and in books, articles, commentaries or otherwise, in any medium now known or later developed. You also warrant that any "moral rights" in any such materials have been waived. You are not entitled to any compensation for such use.

Dunia Link may, at its sole discretion, terminate the registration of any interactive feature user who violates any of the terms and conditions of use.

No Resale of Service

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Producs or Service, use of the Service, or access to the Service.

Termination

You agree that Dunia Link, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any content within the Service, for any reason, including, without limitation, lack of use or if Dunia Link believes that you have violated or acted inconsistently with the Terms and Conditions of Use. Dunia Link may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service may be effected without prior notice, and acknowledge and agree that Dunia Link may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Dunia Link shall not be liable to you or any third-party for any termination of your access to the Service.

Copyright Complaints

Dunia Link respects the intellectual property rights of others, and requires that users of the Dunia Link Sites do the same. In appropriate circumstances, Dunia Link will terminate the registration of any interactive feature user who is responsible for acts of copyright infringement. The designated agent to receive notification of claimed infringement is The Rector at contact@dunialink.com.

Indemnification

You agree to defend, indemnify and hold harmless Dunia Link and any affiliated entities, and each of their officers, directors, employees, agents, representatives, information providers and licensors, from any claims, costs, losses, damages, judgments and expenses, including but not limited to reasonable attorneys' fees and expenses, relating to or arising out of any breach of these terms and conditions, or any use of the Dunia Link Sites, by you or by any other person using the Dunia Link Sites through you or using your password.

Jurisdictional Issues

Dunia Link controls and operates the Dunia Link Sites from the Republic of Kenya. Persons who choose to access Dunia Link Sites from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.

Miscellaneous

These terms will be governed by and construed in accordance with the laws of the Republic of Kenya without regard to any principles of conflicts of law. You agree that any action at law or in equity that arises out of or relates to these terms will be filed only in the local or federal courts located in the Republic of Kenya and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any of these terms and conditions are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions.

This is the entire agreement between you and Dunia Link relating to the subject matter it contains. This agreement may be modified only by posting of changes to these terms and conditions by Dunia Link, or by a writing signed by both parties.
